Export Control Compliance

What are Export Controls?

Export controls require exporters to be responsible for ensuring that their shipments comply with export legislation. To ensure safety, exporters require solid record-keeping systems and procedures in place, thorough training, and clear lines of responsibility.

Most countries have export controls, and those controls persist regardless of the number of times the information or product changes hands or is amalgamated into other information or products.

The Export Control Act 2002 and the associated order, the Export Control Order 2008, together underpin English export control legislation. They provide a list of controlled (military or dual-use) items that fall within this legislation.

What Items Apply to Export Control?

  • Items that have been specially designed or modified for military use and their components
  • Dual-use items (those that can be used for civil or military purposes) which meet certain specified technical standards and some of their components
  • Associated technology and software
  • Goods that might be used for torture
  • Radioactive sources

How Fortra Supports Export Control

Fortra's Digital Guardian supports Export Control regulations in several key ways:

  • Digital Guardian, as well as a data classification solution, helps tag and protect sensitive data related to export-controlled items, aiding in compliance with regulations such as the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR).
  • Robust data loss prevention (DLP) capabilities help to monitor and control the movement of export-controlled data, preventing unauthorized disclosure or transfer to unauthorized parties.
  • Digital Guardian provides monitoring and alerts for suspicious activities involving export-controlled data, facilitating prompt incident response as required by export control regulations.
  • Reporting features can generate compliance reports and demonstrate adherence to export control regulations during audits or regulatory inquiries.
